The VERITAS Pain Validity Test has already been successfully employed without challenge as the basis for expert testimony in numerous cases in a variety of jurisdictions, and upon request we will be happy to provide copies of attorneys’ letters attesting to this.
Virtually all of these cases were settled at the pre-trial stage.
There is every reason to believe that, should it ever be challenged, the Pain Validity Test will be ruled admissible.
That is because it almost certainly fulfills the criteria enunciated in Daubert and the various state-level equivalents thereof.
Specifically, the Pain Validity Test has been:
1. successfully tested over a widespread group of chronic pain patients for a number of years.
2. demonstrated to be highly reliable.
3. subjected to extensive peer review.
4. generally recognized in the profession as a reliable test; multiple authors, from multiple centers, have participated
in the research.
