Malingerer Test Roils Personal-Injury Law
‘Fake Bad Scale’ Bars Real Victims,
Its Critics Contend

In hundreds of cases, expert witnesses have testified that the test provided evidence that plaintiffs were lying about their injuries, just as suggested by the test's colorful name: the Fake Bad Scale....
But now some psychologists say the test is branding as liars too many people who have genuine symptoms. Some say it discriminates against women, too. In May, a panel said there appeared to be a lack of good research supporting the test.
In two Florida court cases last year, state judges, before allowing the test to be cited, held special hearings on whether it was valid enough to be used as courtroom evidence. Both judges ended up barring it.

The unique Veritas expert systems for validating, diagnosing, and treating chronic pain were developed for anyone - insurer, treating physician, defense attorney, plaintiffs’ attorney - who is genuinely committed to fairly compensating legitimate accident victims, and getting them better, while not wasting valuable resources on spurious claimants.
The Veritas expert systems have been extensively documented in the peer-reviewed medical literature, and they have also been successfully employed without challenge as the basis for expert witnesses’ testimony in numerous cases in a variety of jurisdictions.
• validate legitimate chronic pain patients with 95% scientific certainty
• provide the accurate diagnoses, the testing plans, and the treatment regimens that
will get these
genuine sufferers well
• dramatically reduce the time and money wasted on individuals whose complaints of
chronic pain
are not genuine.
To address the problem of accurately differentiating individuals with valid complaints of pain from ones who are malingering, faking, or exaggerating, faculty members at Johns Hopkins University School of Medicine and another highly regarded pain clinic developed a verbal test – the Pain Validity Test – which was originally validated on 796 chronic pain patients, with results published in seven peer-reviewed articles in medical and other journals. As documented in the most recent of these articles, the Pain Validity Test (PVT) can predict - with 95% statistical certainty - which auto accident, workers comp, or other personal injury victims will have moderate or severe abnormalities on objective medical tests* i.e. whose complaints of pain are legitimate.
The PVT is available in English or Spanish and can be completed in 10 to 15 minutes over the Internet under proctored conditions at any one of the nationwide facilities of the largest employment testing provider in the country.
It has been successfully employed by a large number of attorneys in numerous cases in a variety of jurisdictions. More
The Pain Validity Test costs $300.
*including MRIs, myelograms, CTs, 3D-CTs, flexion-extension x-rays, electro- myography, nerve conduction studies, quantitative flow-meter studies, nerve blocks, root blocks, etc. More
The DP&TA was developed with more than 10,000 chronic pain patients over a period of 30 years at the highly regarded pain clinic which co-developed the Pain Validity Test. Business Week recognized this Clinic as one of the top eight pain clinics in the US along with Hopkins and the Mayo Clinic.
It consists of 72 questions with 2,008 possible answers and has been able to achieve a 97% correlation with diagnoses given by the medical director at the Clinic. More
In addition to providing a comprehensive set of actual diagnoses, the DP&TA generates specific and detailed treatment algorithms which begin with the least expensive and invasive tests and treatments and progress through a series of increasingly complex tests and treatments.
By following the recommended course of tests and treatments, a treating physician can expect results which are comparable to those achieved at the clinic.
Like the Pain Validity Test, the Diagnostic Paradigm & Treatment Algorithm is available on-line in English or Spanish. Depending on the nature and number of the patient’s symptoms, it can be completed in 15 to 90 minutes.
The Diagnostic Paradigm & Treatment Algorithm costs $800.
